1. The Service & Beta Status

Archidian provides AI-driven analysis for construction documentation. The Service is currently in Closed Beta.

  • "As-Is" Basis: The Service is provided on an "AS-IS" and "AS-AVAILABLE" basis. We do not warrant that the Service will be uninterrupted, error-free, or free of "bugs."
  • Modifications: We reserve the right to modify, suspend, or discontinue features at our sole discretion to improve model accuracy or system performance without prior notice.

2. AI Disclaimer & Professional Responsibility

Archidian utilizes advanced Large Language Models (LLMs) and vision-analysis technologies.

  • Accuracy: AI may produce "hallucinations," omissions, or technical inaccuracies. Archidian does not provide architectural, engineering, or legal advice.
  • No Professional Stamp: Archidian is a productivity tool, not a licensed professional. We do not provide stamped drawings, official approvals, or code-compliance certifications.
  • User Duty: The User retains 100% responsibility for verifying all AI outputs against official building codes and professional standards. The Service must never be the sole basis for structural, life-safety, or high-cost construction determinations.

3. Intellectual Property (IP)

  • Your Content: You retain all ownership and copyright of uploaded files. By using the Service, you grant Archidian a limited, non-exclusive license to host and process this content solely to provide the Service to you.
  • Tiered Data Usage: As detailed in our Privacy Policy:
    • Paid & Enterprise Tiers: Your data is processed in a transient state and is not used to train foundational AI models.
    • Free & Beta Tiers: Your uploaded content and interaction data may be processed by Archidian and its third-party sub-processors in accordance with their respective services and configurations. Such processing may include temporary storage and analysis necessary to operate, maintain, and improve the Service. Archidian does not control the internal data-handling practices of third-party AI providers beyond contractual and configuration-based limitations.
  • Our IP: You shall not decompile, reverse-engineer, or "scrape" our AI workflows. You may not use Archidian's outputs to train a competing AI model.

4. Technical Infrastructure & Security

The Service operates on a professional-grade stack, including Next.js, Supabase, and Google Cloud Platform (GCP).

  • Security: We employ AES-256 encryption and server-side processing to protect your data.
  • Third-Party Failures: While we select top-tier providers (GCP, Railway, Supabase), Archidian is not liable for service interruptions or data loss caused by these external infrastructure providers.
  • Data Deletion: Per our Privacy Policy, document deletion is currently a manual process. Users must email [email protected] to request permanent data removal.

5. Limitation of Liability

To the maximum extent permitted by law:

  • Excluded Damages: Archidian shall not be liable for indirect, consequential, or punitive damages, including but not limited to construction delays, liquidated damages, permit denials, or professional errors.
  • Liability Cap: Our total aggregate liability for any claim shall not exceed the fees paid by you in the twelve (12) months preceding the claim (or $100.00 USD for Beta/Free users).

6. Indemnification

You agree to defend and indemnify Archidian against any third-party claims arising from:

  1. Your misuse of the Service.
  2. Construction defects or safety failures on projects where the Service was used.
  3. Your violation of these Terms or the intellectual property rights of others.

7. Governing Law & Arbitration

These Terms are governed by the laws of the State of Texas. Any dispute shall be resolved via binding arbitration in Austin, Texas, on an individual basis. Class action lawsuits and jury trials are strictly prohibited.
